Protesters against the Dakota Access Pipeline are shocked over bills introduced by GOP lawmakers that would criminalize road protests, restrict what protesters can wear, and allow the federal government to be sued to cover enforcement costs.

Among the bills, one would exempt drivers from liability if they unintentionally injure or kill a pedestrian obstructing traffic on a public road or highway.

Rep. Keith Kempenich (R-N.D.) crafted the driver exemption bill after his 72-year-old mother-in-law was blocked by protesters waving signs on a roadway.

“They’re intentionally putting themselves in danger,” Kempenich said of the protesters.

North Dakota Lawmakers Introduce Bills Inspired By Pipeline Protests

North Dakota’s Republican-led and largely oil-friendly Legislature is quickly introducing a raft of bills spurred by the bitter dispute between Dakota Access protesters and law enforcement.

Another bill would make it a crime for an adult to wear face masks.
State Republicans said the bills introduced last week were motivated by residents’ frustration with the ongoing protests in the southern part of the state, which at times saw a thousand-strong encampment opposing the building of the $3.8 billion state pipeline.

When people are having their lives disrupted, you’re going to see things move up here, Sen. Kelly Armstrong, an oil company executive, and state Republican chair told AP. It’s very difficult to write ‘protest laws.’ We need to make sure there is reasonable application of the law in all circumstances, whether protest-related or not.

Another bill would require the state attorney general to sue the federal government to help cover some of the more than $22 million in state law enforcement costs incurred since the protests began last summer. There have been nearly 600 arrests in the region since August.

There is Democratic opposition to the bills. Rep. Marvin Nelson (D-N.D.) told AP, “knee-jerk legislation often is poor legislation.”

The bills were also drafted without consultation from the Standing Rock Sioux Tribe, according to the tribe’s chairman, Dave Archambault II.

“The state claims they want to work closely with the tribe on repairing our relationship with them,” Archambault told NBC. “Clearly that is not happening when legislation that impacts us is being drafted without consultation, consent or even basic communications.”

The proposed legislation comes just over a month after the US Army Corps of Engineers denied Energy Transfer Partners, the Dallas-based company funding the pipeline project, a permit to cross the Missouri River, plus a notice that the agency will conduct an environmental review of the site.

It’s shocking to see legislation that allows for people to literally be killed for exercising their right to protest in a public space, Tara Houska, national campaigns director for Honor the Earth, a nonprofit organization focused on indigenous environmental justice, told NBC.

The bill will be heard by the North Dakota House Transportation Committee on Friday.

Court Docs Show Dakota Protesters Allegedly Threatened To Assassinate ND’s Governor.

Cody Larson, an analyst with the state’s Bureau of Criminal Investigation Criminal Intelligence, detailed numerous threats on social media against former Gov. Jack Dalrymple, including a Dec. 12 call to the Republican’s office demanding the governor resign “or he won’t make it until Wednesday.”

North Dakota’s law enforcement officers said highway patrol took the threats seriously, and beefed up the governor’s security, according to court filings connected to a lawsuit filed in November accusing police of excessive force in a Nov. 20 clash.

“He normally didn’t have Highway Patrol with him a lot of the time. They were more in the vicinity after the threats,” Chief of Staff Ron Rauschenberger said in the filings.

Running over protesters on roadways could soon be legal in North Dakota.

Republican lawmakers in the state introduced a bill last week in the legislature that would not hold motorists liable for negligently running over someone obstructing a roadway. The bill was introduced in response to a year of protests over a proposed pipeline near the Standing Rock Indian Reservation.

“A driver of a motor vehicle who negligently causes injury or death to an individual obstructing vehicular traffic on a public road, street, or highway may not be held liable for any damages,” the bill reads. “A driver of a motor vehicle who  unintentionally causes injury or death to an individual obstructing vehicular traffic on a public road, street, or highway is not guilty of an offense.”
